1. TERMS AND DEFINITIONS

  1. The following terms are used in this Policy:
    1. "Administration of the website of the online store (hereinafter referred to as the Site Administration)" - persons authorized to administer the website who organize and/or process personal data determine the purpose of their processing, the list of data to be processed and the operations performed with them.
    2. "Personal data" - information that directly or indirectly relates to an individual (data subject) who is registering or otherwise interacting with the website.
    3. "Processing of personal data" - any operation or set of operations with personal data performed with or without the use of automated means, such as collection, recording, organizing, accumulation, storage, updating, modification, extraction, use, transfer (access, distribution), depersonalization, blocking, deletion or destruction.
    4. "Confidentiality of personal data" - the Operator's obligation not to disclose this data without the subject's consent or other legal basis.
    5. "User of the website of the online store (hereinafter referred to as the User)" - a person who accesses the website and uses its functionality via the Internet.
    6. "Cookies" - is a small set of data sent by a web server and stored on the User's device that a web client or browser sends to the server each time it requests to view a page of the site.
    7. "IP address" - is a unique identifier of a device in an IP-based network.

2. MAIN PROVISIONS

  1. The use of the Online Store website by the User indicates his/her acceptance of this Policy and the terms of processing of his/her personal data.
  2. If the User does not agree with the provisions of this Policy, he/she must stop using the Website.
  3. This Policy is valid exclusively for the website of the online store "Karpat-Vin Etalon". The store is not responsible for third-party sites to which the User can go through the links posted on the site.
  4. The Site Administration does not verify the accuracy of the personal data provided by the User.

3. POLICY SUBJECT

  1. This Policy defines the obligations of the Site Administration to protect the confidentiality and non-disclosure of personal data that the User must provide upon request when registering or placing an order on the Site.
  2. The personal data that is allowed to be processed under this Policy is entered by the User independently through the registration or order forms on the Karpat-Vin Etalon website and includes:
    1. Surname, first name, patronymic of the User;
    2. Phone number for communication;
    3. Electronic mail (e-mail);
    4. The address for delivery of the goods (including the number of the Nova Poshta branch).
  3. The online store protects data that is automatically collected when you view pages or advertising materials with an embedded statistical script ("pixel"):
    • IP address;
    • data from cookies;
    • information about the browser or program used to access the site;
    • time of visit;
    • the address of the page with the advertisement;
    • referrer (address of the previous page).
    1. Disabling cookies may restrict access to secure parts of the site that require authorization.
    2. Statistics of visitors' IP addresses are collected to analyze technical problems and control the legality of payments.
  4. Other information (purchase history, browser type, operating system, etc.) not specified above is stored securely and is not disclosed, except as described in clauses 5.2 and 5.3 of this Policy.

4. PURPOSE OF COLLECTING USER DATA

  1. The Site Administration may use the User's personal data for:
    1. Identification of the User registered on the website for placing an order or concluding a purchase agreement with Karpat-Vin Etalon remotely.
    2. Providing access to personalized website features.
    3. Ensuring communication with the User, including sending notifications, responding to requests for information regarding the use of the Website or services.
    4. Determining the location of the User for security and fraud prevention.
    5. Checking the accuracy and completeness of the data provided.
    6. Registration of an account for purchases with the consent of the User.
    7. Informing the User about the status of their order.
    8. Providing technical and customer support in case of problems with the website.
    9. Sending the User (with their consent) information about products, promotions, prices, news from the store or its partners.
    10. Conducting advertising campaigns with the consent of the User.
    11. Providing access to partner sites or services to obtain products or services.

5. METHODS AND TERMS OF DATA PROCESSING

  1. The User's data is processed indefinitely, by legal methods, using automated systems or manually.
  2. The User authorizes the Administration to transfer his/her data to third parties (for example, courier services, postal operators, telecommunication companies) solely for the purpose of fulfilling the order placed on the Website, including the delivery of goods.
  3. Data may be transferred to state authorities of Ukraine only by law and in accordance with the established procedure.
  4. In case of loss or disclosure of data, the Administration shall notify the User thereof.
  5. The Administration takes technical and organizational measures to protect data from unauthorized access, destruction, alteration, blocking or dissemination.
  6. The Administration, together with the User, prevents losses from data loss or disclosure.

6. RESPONSIBILITIES OF THE PARTIES

  1. The user is obliged:
    1. Provide the necessary data to work with the site.
    2. Update data in case of changes.
  2. The administration is obliged:
    1. Use the data only for the purposes described in clause 4 of this Policy.
    2. To keep the data confidential, not to disclose it without the written consent of the User, except as provided for in clauses 5.2 and 5.3.
    3. Protect data in accordance with standards accepted in business practice.
    4. Block the User's data for the period of verification at the User's request or at the request of authorized persons in case of inaccuracies or violations.

7. RESPONSIBILITY OF THE PARTIES

  1. The Administration, which has violated its obligations, shall be liable for damages from the misuse of data under the laws of Ukraine, except as provided for in clauses 5.2, 5.3, 7.2.
  2. The Administration is not responsible for the loss or disclosure of data if:
    1. They became public before they were lost or disclosed.
    2. Received from a third party prior to their transfer to the Administration.
    3. Disclosed with the consent of the User.

8. DISPUTE RESOLUTION

  1. Before going to court, the parties are required to submit a written claim for voluntary settlement of the dispute.
  2. The recipient of the claim shall respond in writing within 30 days from the date of receipt.
  3. In the absence of agreement, the dispute shall be referred to the court in accordance with the laws of Ukraine.
  4. This Policy and the relationship between the User and the Administration are governed by the laws of Ukraine.

9. ADDITIONAL CONDITIONS

  1. The Administration may change this Policy without the consent of the User.
  2. The updated Policy comes into force from the moment of its publication on the website, unless otherwise specified.
  3. Any suggestions or questions regarding this Privacy Policy should be reported through the "Contact Us" section on the website of the Online Store.
