1. GENERAL PROVISIONS

  1. This agreement is a public offer agreement (in accordance with Articles 633, 641 and Section 63 of the Civil Code of Ukraine), its terms and conditions are the same for all buyers regardless of their status.
  2. In case of acceptance of the terms of this agreement, i.e. the public offer, the user becomes the Customer.

2. TERMS AND DEFINITIONS

  1. Website. - a set of pages accessed through a web browser and program modules united by a single management system located on the Internet at https://cotnar.ua, and containing all the features of this public offer.
  2. Performer. - Individual entrepreneur Gavrylenko Anatolii Yuriiovych.
  3. Products. - a list of wine and other wine products published on the Website.
  4. Buyer - a natural person who has reached the age of eighteen who purchases the Goods presented on the Website for purposes not related to business activities; or a legal entity/individual entrepreneur.
  5. Order. - the Customer's application addressed to the Contractor for the purchase and delivery of the Goods has been completed and posted on the Website.

3. SUBJECT OF THE CONTRACT

  1. This Agreement defines the procedure for interaction and the terms of the Contractor's services to the Customer.
  2. The Contractor shall provide the Customer with the services of placing an Order, purchasing and delivering the Goods reserved by the Customer on the Website.
  3. For the purpose of retail purchase of the Goods, as well as to organize the delivery of the Goods to the Buyer:
    • The Customer independently places an order for the purchase of the Goods through the website https://cotnar.ua or directly in a company store,
    • The Customer pays the cost of the Goods at the cash desk of the company store or through payment systems on the website https://cotnar.ua,
    • The Contractor shall ensure the quality packaging of the Goods and transfer them to the Nova Poshta delivery service,
    • The Contractor shall send the Goods to the address specified by the Customer or to a branch of Nova Poshta in accordance with the Customer's request. The details of the recipient of the Goods shall be specified by the Customer.

  6. The Customer accepts the terms of this agreement at the time of placing the Order by clicking on the "Place an order" button, which expresses the Customer's confirmation of reading the text of this agreement and agreement with its terms. In the future, the Customer's objection to the provision of its consent in this way relieves the Contractor of any liability for failure to comply with the terms of this agreement and reserves the right to cancel the Order unilaterally and/or replace the ordered but unavailable goods with similar ones, the Customer, in turn, has the right to refuse to accept such goods.

4. ORDERING PROCEDURE

  1. The Customer places an Order on the Website independently by adding the selected wines to the virtual basket and clicking the "Checkout" button.
  2. As a result of placing an Order, the Contractor receives the Customer's data and the Order number to perform services for the purchase and delivery of reserved goods in accordance with the generated Order on the Site.
  3. All Customers who are 18 years of age or older, regardless of registration, can place an Order for wines.
  4. Orders are processed daily from 9:00 to 18:00, except weekends and holidays.

5. PAYMENT PROCEDURE

  1. The Customer adds the wines specified in the order placed on the Website, as well as pays for the Contractor's services for their search, ordering and reservation.
  2. The Customer pays for the Contractor's services for the purchase and delivery of wine products specified in the order placed on the Website, and also undertakes to compensate the actual costs of the Contractor for the fulfillment of the terms of this Agreement in a convenient form of payment: in cash upon receipt of the goods or by bank transfer to the Contractor's account.
  3. The Customer may make payment on the day of delivery of the Goods to the address specified by him/her at the Nova Poshta branch by cash on delivery - payment for the goods upon receipt at the post office. Payment is made in the national currency of Ukraine - hryvnia.
  4. Payment shall be made after the Customer has familiarized himself with and checked the range of goods ordered and delivered at the place of delivery specified by him.

6. ORDER DELIVERY, PAYMENT AND PROCESSING OF ORDERS

  1. Delivery terms:
    1. The order is collected immediately after receiving the order. We try to send your order as soon as possible, but in some cases it takes up to 1 business day to collect the order. Therefore, if you are limited in time, please inform the manager, we will do our best to dispatch it promptly.
    2. Orders are shipped by Nova Poshta. We value our reputation and pack the goods with high quality, but we ask you to check the integrity of the parcel at Nova Poshta due to the fragility of the goods.
    3. Delivery fees are charged according to the terms of the carrier's company and are fully borne by the client.
  2. Payment terms:
    1. The minimum order amount is 100 UAH.
    2. All orders paid in full prepayment are shipped on a priority basis.
    3. You can pay for your order with a card on our website during the ordering process.
    4. Warning. We cannot identify the payment in such cases:
      • if it is made through a terminal without specifying any information about the payer;
      • if it is made from a third-party card without specifying the customer's name;
      • if the order number is not specified in the comment.
  3. When transferring the Order, the Contractor shall have the right to ask the Customer to present an identity card confirming that the latter complies with the age restrictions established for the Customers hereunder.

7. 7. OTHER TERMS AND CONDITIONS

  1. This agreement is concluded in Ukraine and is governed by the substantive law of Ukraine.
  2. By this agreement, the Buyer agrees to the processing of his personal data.
  3. The invalidity of any clause or part of this agreement shall not lead to the invalidity of the agreement as a whole.
  4. All disputes arising between the Customer and the Contractor shall be resolved through negotiations. In case of failure to resolve the dispute, the parties may apply to the judicial authorities in accordance with the applicable law.
  5. The Contractor shall have the right to amend the text of this Agreement at its sole discretion at any time and without prior notice to the Customers. The current (valid) version of the Agreement is always posted on the Website.
