Terms and conditions of payment, delivery, exchange and return of goods

1. DEFINITIONS

  1. The following abbreviations are used in these Rules:
    • Seller. - Karpat-Wine Etalon LLC, which produces wines and other wine products and owns the Karpat-Wine Etalon branded store.
    • Buyer - an individual who buys the Seller's products in the Carpathian-Win Etalon store as an end user.
    • Products. - wine and other products manufactured by the Seller.

2. TERMS OF PURCHASE AND DELIVERY

  1. For the purpose of making a retail purchase of the Products, as well as to organize the delivery of the Products to the Buyer:
    • The Buyer shall independently place an order for the purchase of the Products in the Carpathian-Win Etalon branded store through the website https://cotnar.ua or directly in the store.
    • The Buyer, in accordance with the agreed order, pays the cost of the Products to the cash desk of the Carpathian-Win Etalon company store or through payment systems on the website https://cotnar.ua.
    • The Seller shall provide high-quality packaging of the Products and transfer them to the Nova Poshta delivery service.
    • The Seller shall send the Products to the address specified by the Buyer or to a Nova Poshta branch in accordance with the Buyer's request. The Buyer shall specify the details of the recipient of the Products.

3. PAYMENT FOR PRODUCTS

  1. Payment for the Products shall be made by the Buyer directly to the Seller's account using the payment systems on the website https://cotnar.ua or in another way at the Buyer's option.

4. BUYER'S WARRANTY

  1. The Buyer warrants that he/she has no age and/or other restrictions on the purchase of wine products. In case of violation of this guarantee, the Buyer undertakes to compensate the Seller for losses associated with possible sanctions of regulatory authorities.

5. PRODUCT INSPECTION

  1. The Buyer is obliged to check the completeness and integrity of the Products at the Nova Poshta branch (upon receipt of the Products at the branch) or with the courier (in case of targeted delivery). In case of damage to the Products, the Buyer shall file a claim with Nova Poshta.

6. CONFIRMATION OF RECEIPT

  1. By receiving the Products at a Nova Poshta branch or by courier, the Buyer confirms that the Products are not damaged, received in full and in the assortment in accordance with the order.

7. NOTIFICATION OF NONCONFORMITIES

  1. In the event of any discrepancies found upon receipt of the Products, the Buyer shall immediately notify the Seller by phone.

8. EXCHANGE AND RETURN

  1. The exchange and return of goods is regulated by the Law of Ukraine "On Protection of Consumer Rights".

9. RIGHTS OF THE BUYER IN CASE OF DEFECTS

  1. In accordance with the current legislation of Ukraine, in case of defects, falsification of alcoholic beverages, sale of them in improper quality, the Buyer has the right to demand from the Online Store:
    • replacement with a similar product of good quality,
    • replacement with another product with a corresponding recalculation of the selling price,
    • refunds.
  2. In order to replace the goods or make a refund, the Buyer must provide a payment document of the established form issued by the Seller upon purchase of the goods, confirming the fact of purchase, with a mark on the date of sale.

10. RESTRICTIONS ON RETURNS

  1. In addition, when placing an order that includes alcoholic beverages, the Buyer agrees that he/she has the right to refuse only the entire list of ordered products, and not part of it.
  2. Alcoholic beverages of the proper quality are not subject to exchange and return.
